Great trial cross-examinations are the product of equal parts planning, discipline, and creativity. In many respects, a well-crafted cross-examination is a technical exercise guided by adherence to basic principles of advocacy and structured within the confines of the rules of evidence. But in the end, it is an art form that elevates the attorney’s ability to persuade and win the case. This presentation will identify the tools that are used to build a skilled cross-examination, suggest modes of preparation, and provide thoughts on style, pace, and command. The key is drawing on the advocate’s imagination and coupling it to a winning formula of courtroom execution. There is no more important element of the trial craft than the successful cross-exam.
