The judges will discuss trial and docket management/difficulties that began in March 2020 and persist in some fashion today. This will be a panel discussion, and the judges will touch on the following topics:
- Conducting trials with COVID protocols from the practitioner’s standpoint;
- Problems with delays in preparing cases for trial, including delays in reaching stipulations, agreements regarding the use of Webex, and jury instructions;
- Cost/benefit analysis regarding remote attendance by parties, witnesses, and counsel;
- An increase occurrence of incomplete or incomprehensible records due to sound quality, picture quality and background distractions;
- Percentage of civil cases compared to criminal cases going to trial;
- Counsel and litigant perception of the justice system following protracted shutdowns;
- Issues with physical layout of the courtroom, the jury, counsel and parties;
- Decrease in “second chair” attorneys since trials have resumed with COVID protocols in place;
