Stuart Jorgensen, Stuart S. Jorgensen and Associates, and Kari Jones, Foster Graham Milstein & Calisher, LLP will speak to members of both bars regarding the Supreme Court's revised C.R.C.P. 16.1 procedures which apply to cases filed after September 1, 2018. The presenters will discuss some of the more remarkable rule modifications and potential confusion that might arise if the parties do not address possible interpretations of the modifications.
The CLE will address the parties’ ethical duty to discuss the limiting nature of 16.1 with their clients, and the presenters will discuss the possible implications of the rule’s language regarding scope of disclosure, the nature of the privilege log, and the requirement that the disclosures be signed under oath.
There are limited but important changes to disclosures, discovery, case management conferences, timing of deadlines, and ethics. The presenters will offer some "best practices" for moving forward with these cases.
After the presentation, we will also be honoring this year's Professionalism
