 An interactive discussion on how recent applications of theHomeowner's Protection Act ("HPA") in cases also governed by CDARA may affect the landscape of construction defect litigation. This CLE will include a discussion of the recent Court of Appeals decision in Broomfield Sr. Living Center v. Brinkmann, which found the HPA applicable to an assisted living facility construction project dispute.

The discussion will also include the Taylor Morrison v. Terracon case and whether the HPA can be applied to invalidate limitation of liability clauses in construction contracts. This interactive discussion is expected to provide participants with greater insight into how application of the HPA may affect construction projects and contracting at the outset, insurance afforded to construction professionals, and claims and defenses in construction defect litigation.
