There has been an inundation of ADA public accommodation suits. Plaintiffs will often file separate, identical lawsuits alleging that they do not have full, equal access to and enjoyment of facilities, goods, services and amenities because of their disabilities. Such plaintiffs filed these suits in their capacities as customers, and as “testers.”
This panel presentation and discussion will focus on ADA Title III enforcement, and the bases for these extensive lawsuits, including the types of barriers causing such lawsuits. The panel presentation will provide defense counsel with strategies and tactics in defending the inundation of these “drive-by” ADA public accommodation lawsuits, and in advising their clients on the prevention of potential future lawsuits in light of the applicable law.
