UM/UIM Case Law Update and Working
with UM/UIM Workers’ Comp Claims

Jeff Ruebel and Casey Quillen will provide a review of the current UM/UIM statutory scheme as a backdrop for an analysis of current UM/UIM issues.
We will also review pertinent case law, including the intersection of UM/UIM benefits and worker’s compensation coverage.
We will highlight the recent 2012 Court of Appeals decision distinguishing Hillyer and how trial judges have been handling requests for set offs against workers’ compensation benefits.
There will be a group discussion of recent trends in the trial court and analyze the varying Orders trial judges have recently issued addressing defendants’ motions for post-verdict adjustments of UM/UIM benefits when the policy contains a workers compensation set-off clause.
During the second half hour, we will provide analysis and lead discussion on the following UM/UIM topics:
- The exhaustion of limits before triggering UM/UIM coverage
- Advancement of undisputed funds
- What constitutes and “offer” in the context of UM/UIM coverage
- UM/UIM coverage in the age of 42-7-414
The objective of this CLE is to review UM/UIM basics before engaging in critical thought and analysis of the current issues the CDLA membership and our clients are facing in the trial court.
