This is the first of a multi-part series, which will discuss trial techniques, strategy and evidentiary considerations for all phases of a trial.  This session will cover the steps that should be taken to prepare a case for trial in federal court.  Topics will include assessment of the evidence necessary to prove your case; selection of a “theory of the case”; identifying potential witnesses and exhibits; determining how to “lay the foundation” for the admission of exhibits; identification of “problem” witnesses and developing strategies to deal with them; organizing documentary evidence and witness statements; familiarizing yourself with the courtroom and the judge; and preparing visual aids.  This session will include discussion of Federal Rules of Evidence governing authentication [Rules 104(b), 901, and 902] and use of summary charts [Rule 1006].
