Every Chapter 11 case starts with the best intentions: to shed unsustainable debt, pay legitimate creditors, and reorganize the business so it can survive and grow.  But sometimes a very different reality sets in.  Your client wants to reorganize, but cash flow is negative, administrative expenses are piling up, and the narrow road to reorganization is quickly disappearing.  This program will explore practitioners’ obligations when a bankruptcy estate is “circling the drain.”  The panelists will offer practical advice on how to balance ethical considerations and fiduciary responsibilities against their own clients’ desires and the human dynamics that often come into play when business owners are forced to contemplate the loss of their investments.
