PROGRAM OBJECTIVES:

Attorney Rebecca King will address the different definitions of capacity, and explain how attorneys assess capacity in a legal and ethical context, including the capacity to make a gift, the capacity to execute estate planning documents, and the capacity to make informed medical consent decisions. The presentation will also address the difference between a durable power of attorney and guardianship, and how the court determines if a person is legally incapacitated. This presentation will reference the CCMC Code of Professional Conduct for Case Managers

 Rebecca King has over twenty-five years of experience serving seniors in a variety of settings.   She holds her Bachelor’s Degree in Social Work from the University of South Florida and her law degree from Seattle University.    Prior to entering the practice of law, Rebecca worked as a hospice and skilled nursing facility social worker, a hospital discharge planner, and an assisted living administrator.  She has served as an instructor at Western Washington University teaching a class on Law and Social Policy.  Rebecca’s law practice provides services in elder law, estate planning, guardianship, and probate.  She is a member of the Washington State Bar Association Elder Law Section and the Washington Academy of Elder Law Attorneys.
