New York Overhauls Its Anti-Harassment Laws Again: Everything the Long Island Employer Needs to Know to Stop Harassment Now and Mitigate Risk

In the final hours of the 2019 Legislative Session, New York passed a number of bills that significantly expand, among other things, its anti-harassment laws….again.  However, rather than focusing on policies or training, these new laws, which Governor Cuomo has now signed and which are expected to take effect this October, literally re-write the book with respect to the prevention and defense of sex harassment and other claims.  Among other things, the state has effectively abolished the “severe and pervasive” standard and increased protections to employees that will make such claims far more lucrative for Plaintiffs and their counsel unless employers take proper and strategic measures now to prevent harassment and limit risk.

Please join us, with our partners at Jackson Lewis P.C., for a comprehensive session and “deep dive” into this new legislation and recommended strategic decisions where attendees will learn:

  • Expansion of the state’s definition of sex harassment;
  • Further limitations to non-disclosure provisions and arbitration agreements, including strategic decisions regarding the appropriate, lawful utilization of these types of provisions;
  • Increased protections for non-employees;
  • Increased statutes of limitations;
  • Increased categories of discrimination;
  • Increased damages available to Plaintiffs who meet these lowered thresholds for defining workplace harassment;
  • Changes to make now to policies, training and investigations to comply with new requirements and protect your organization;
  • Likely changes to the landscape of employment litigation including possible limitations to agency investigations of such claims;
  • Strategic recommendations to better protect your organization should claims arise.
