Confidentiality and Consent:  Law, Ethics and Dilemmas

As a therapist, are you concerned about understanding the requirements of the law and government guidance on capacity and consent, and negotiating consent issues with clients and others? Then this half-day course is for you! 

The course will help you answer these questions:

  • Who can give consent for therapy for adult and child clients?
  • What does the law say about capacity to give consent?
  • How do I negotiate consent with my client?
  • How do I negotiate consent issues with separated parents in relation to therapy with their child?
  • How do I manage confidentiality and also provide carers, other professionals and the courts with necessary safeguarding information?
  • How and when should I share information without the client’s consent?

This half day course is facilitated by Dr Barbara Mitchels, FBACP, who is a practising psychotherapist with dual qualifications in law and therapy. Her work as a lawyer included being a solicitor advising and representing local authorities, parents, guardians and children in the child protection field for many years. She also writes books and legal resources for the counselling professions, the most recent being with Tim Bond ‘Confidentiality, Consent and Record Keeping in Counselling and Psychotherapy’, Sage (2021). The course includes facilitator input, experiential activities, group discussions, and handouts.
