New Hampshire practitioners consistently face challenges in their practice. Certain issues can catch practitioners off-guard and are the more common subject of licensing Board complaints. This conference will address issues of particular concern in recent years in New Hampshire, including release of records, work with members of high-conflict and/or Court-involved families, multiple roles, and boundaries.  This conference will also examine issues that all practitioners should be aware of with regard to ethically closing a practice.

This workshop is designed to help participants:

  1. Examine areas of high-risk when providing services to high-conflict families and describe how to prevent adverse outcomes
  2. Identify and explain the practitioner's proper role in Court and how to maintain that role despite pressures placed on the practitioner by the Court or counsel
  3. Identify particularly problematic areas with regard to reunification work and describe how to navigate those issues successfully
  4. Recognize responsibilities with regard to the release of records and confidential information
  5. Identify and list your obligations with regard to closing your practice
  6. Examine and discuss ethical quandaries for practitioners related to boundary violations
  7. Identify and address key steps practitioners can take from a risk management perspective to provide mental health services safely and effectively

Presenter Bio: Andrea Daly is a partner at Robinson, Boesch, Sennott & Masse, P.A.  Her areas of practice include probate law and mental health law. She received her undergraduate degree from Boston University in 1991 and her Juris Doctor degree from Vermont Law School in 1997.

Andrea has had extensive experience within the mental health field.  She has defended dozens of physicians, social workers and psychotherapists, before their state licensing boards and understands how the boards operate and what the boards' expectations are for licensees.  In addition, she represents patients who have brought claims against individual practitioners and organizations. A large part of Andrea’s practice involves training and providing on-going risk management advice to licensees on issues related to ethics, confidentiality, informed consent, reporting laws, records management, and other legal issues related to mental health care and medical care.
