Gifts of Real Estate: Challenges and Opportunities

Program Description:
Real estate gifts, both outright and to fund life income plans, often carry risks and challenges not present with gifts of cash or securities. Among them, from the donor and their advisor’s perspective, may be the trigger of bargain sale rules, depreciation recapture, and appraisal and substantiation concerns. From a charity’s standpoint, issues may center on unrelated business taxable income (UBTI), prearranged sale rules, marketability and liquidity, and/or management and holding period of the real estate. Although the process may be daunting at times, once donors, their advisors, and charitable organizations have worked through the tax and legal ramifications, a gift of real estate may present an excellent opportunity to fulfill a donor’s philanthropic intent and support the charity’s mission. Join Mr. Knox as he works through the legal and tax rules applicable to gifts of real estate, as well as real-life scenarios where overcoming challenges of complex real estate gifts resulted in considerable opportunity to donors and charitable organizations.

Bill Knox is the Director of Technical Consulting for TIAA Kaspick. He provides expert tax and technical advice to Kaspick and its clients on all aspects of charitable organizations, estate planning, charitable giving and gift administration. Bill has worked in the field of philanthropy for more than 15 years and regularly presents on a variety of estate and gift planning topics at both regional and national events. Bill has a BA from the California State University, Chico. He received his JD from the Columbus School of Law at the Catholic University of America in Washington, DC and his LL.M in Tax from Loyola Law School, Los Angeles, CA.
