Please read the waiver & artist agreement below.  By continuing with the registration process, you will be agreeing to the waiver & artist agreement.

WAIVER and ARTIST-SEA AGREEMENT FORM

INDEMNIFICATION:  VENDOR hereby agrees to protect, indemnify, defend and save SEA (Society for East End Arts), officers, trustees, employees and agents harmless from and against any and all claims, demands, actions, damages, loss, cost liabilities, expenses and judgments arising out of or occurring in connection with any act, omission, negligence or misconduct of VENDOR or any of its agents, servants, employees, contractors, guests, licensees or invitees; or violation by any of them of any law, ordinance or governmental order of any kind; or when any such injury or damage may in any other way arise from or out of the occupancy or use of VENDOR.  Such indemnification of SEA by VENDOR shall exclude any such liability caused by the sole negligence or willful misconduct of SEA, and their servants, employees, contractors, guests, licensees, or invitees. VENDOR covenants and agrees that in case SEA shall be made a party to any litigation commenced by or against VENDOR or relating to this Agreement, then VENDOR shall and will pay all costs and expenses, including reasonable attorney’s fees and court costs, incurred by or imposed upon SEA by virtue of any such litigation.


PROPERTY DAMAGE:  SEA shall not be responsible for any loss of or damage to property of the VENDOR, including, but not limited to, loss or damage occasioned by theft, fire, smoke, acts of God, public enemy, riot, civil commotion or other insurable casualty, and VENDOR expressly waives any claim for liability against SEA with respect to any such loss or damage. Accordingly, it shall be the responsibility of VENDOR to secure its own insurance or otherwise protect itself and its property against such loss or damage.

 

ARTIST-SEA AGREEMENT

1.  SEA expects artists to have their booths open and staffed during all Sale hours.  Artists may have someone else staff their booth.  Contact the Coordinator if you are unable to staff your booth, otherwise your booth will be offered to artists on the waiting list.

2.  The SEA Holiday Sale has a waiting list of artists who would like to be in the Sale.  If you find that you need to cancel your participation, even if it is the day before or day-of the Sale, please contact Sale Coordinator Solange Kellermann so we can fill your booth with someone from the waiting list. 

3.   Not following these policies will affect your application to future SEA Holiday Art Sale.
