Protect Your Startup's Intellectual Property

Most startups have just a few products or concepts. Losing them to a competitor would spell disaster, since the value of the firm is strongly linked to them. Yet, it happens all the time, as companies with greater resources copy, replicate, or steal the intellectual property of entrepreneurial firms. Generally, they assume that startups will not be able to afford a prolonged legal battle.

Fortunately, new companies - whose owners and managers often have spent years creating and refining novel products and services - are not powerless. The field of intellectual property is now well developed, and offers several methods and tactics to protect entrepreneurs. However, most startups are not up-to-speed in terms of protecting themselves in advance, or knowing how to respond if they find that others are using their technology.

The program will focus on the following topics:
- Primary intellectual property issues for the startup sector  
- Proactive steps to take to make your Intellectual Property difficult to replicate  
- How to guard your trademarks, trade secrets, and design rights  
- Methods to protect your products through copyrights and patents  
- What to do if Company X is selling products based on your Intellectual Property

 Calvin Chu

is Managing Director of Techstars, and runs its R/GA Accelerator. He is also an angel investor,  who  funds ten seed stage startups per year in the Internet sector. Techstars runs several accelerator  programs, and  connects participants with 75 angel & venture capital investors. Previously, Calvin  managed the IP of Columbia  University's computer technology portfolio. 




 John Hempill is a Partner in the Corporate Practice group of Sheppard Mullin at the firm's New York office. He has  extensive experience in private finance - representing emerging growth companies, venture capital funds, and  strategic investors in seed rounds and later stage financings. John was selected by his peers for inclusion in The Best  Lawyers in America, 2014 edition.

 Gary Walpert is Of Counsel at Byrne Poh, where he focuses on licensing, patent opinions, patent and trademark  prosecution, and due diligence matters relating to patent enforcement. In this connection, he has prepared numerous  infringement opinions. Gary was named as a Massachusetts Super Lawyer in intellectual property in the 2004 through  2008 issues of Boston Magazine.
