Order Now!INDEMNIFICATION, WAIVER AND FEE AGREEMENT: By continuing with the ordering process, the Recipient, in consideration for assistance and/or aid importing, receiving and/or acquiring certain donated and/or purchased medical products for use with the COVID-19 coronavirus, indemnifies and holds harmless The Midwest USA Chinese Chamber of Commerce, including its officers, directors, agents, attorneys, representatives and members (hereinafter collectively M3C) from and against any and all claims, costs, expenses, damages and liabilities (including such claims, costs, expenses, damages and liabilities based on liability in tort, including strict liability in tort), reasonable attorneys’ fees, disbursements, taxes, duties, and other costs of investigation or defense (including those incurred upon any appeal), that may be alleged, asserted against or incurred by M3C as the result of or associated with such purchases, donations, assistance and/or aid. Recipient further waives and and all claims and demands, known and unknown, that Recipient may have against M3C for its assistance and aid importing and/or acquiring certain medical products for use with the COVID-19 coronavirus. Nothwithstanding the foregoing, any claims and demands which result solely from the willful misconduct of M3C are not included within the scope of this indemnification and waiver. Recipient understands and acknowledges that the price, fees and costs associated with acquiring the requested medical products may be greater than expected due to no fault of M3C. By way of illustrative, non-limiting examples, fuel costs may increase, freight traffic may be re-routed due to weather concerns and customs duties may change. Recipient agrees to promptly and automatically pay such increased prices, fees and costs upon presentation of documentation thereof by M3C.
