Uber, Google, DuPont, Gillette are just the most recent examples of companies rocked by employees stealing confidential information and breaching restrictive covenants. What are the lessons to be learned? How are companies and executives to know when taking corporate documents is theft and when it is protected whistleblowing activity? What are the legal and ethical pitfalls for employers and their attorneys when investigating employee data breaches and non-compete violations? How has the new federal Defend Trade Secrets Act changed trade secret and restrictive covenant litigation? What are the best practices for preventing, detecting and responding to threats to corporate data and company relationships? We will explore the answers to these and other current dilemmas facing companies and their representatives.

10:45 AM - 11:45 AM Help ... My Employee is a Member of a Hate Group: Can Employers Terminate Employees for Hate Speech in the Workplace or Participating in Off Duty Protests?

It’s an employer’s nightmare. An employee shows up in a video making the rounds on social media taking part in a protest or other off duty conduct that includes violent clashes and racist insults. Or you over hear an employee in the breakroom expressing racist views that are contrary to the Company’s principles. The employer wants no association with such actions and views and decides to part way with the employee. But, will there be legal trouble if the employee is fired? This presentation will focus on the rights of an employer to take action against employees for engaging in hate-related speech and conduct both in and outside the workplace.
