Differing site conditions can be a confusing issue for contractors to deal with. Can you recognize a differing site condition and identify what type of differing site condition something is? Are you able to distinguish between a “change” and a different site condition? What about notice – do you know how to protect your claim rights and get paid for the costs incurred with dealing with a differing site conditions?

In this webinar, Obermayer’s experienced government contracts attorneys will discuss the function and purpose of the differing site condition clause.  We will go over the notice requirements for differing site conditions, showing contractors how to protect their claim rights and get compensated for differing site condition damages.

We will also discuss how to keep a project moving forward in the face of a differing site condition, especially when the government attempts to deny its existence.   Next, contractors will learn how to distinguish a differing site condition from a change or a defect in specifications.

Finally, we will discuss how to overcome some of the government’s such as notice and site investigation. Contractors providing construction services, IT infrastructure, cybersecurity, and location based services can all benefit from this presentation on two of the most common, but frequently difficult to prove, claims against the government.
