CFPB: PERMISSIONS, PROHIBITIONS AND REGULATORY CHANGES -- Every conversation regarding the mortgage industry begins and ends with four letters: “CFPB.”  As if the concerns of the CFPB were not enough, there are many myths, untruths, and unknowns circulating throughout the industry regarding the CFPB.  This session will provide in depth insight on the CFPB, including the latest on LO comp, QRMs, the compliance issues they are focusing on, when they will start auditing lenders and brokers, what to expect in an examination, what actions or practices are allowed and which ones are prohibited.  Those in attendance will have a head start in preparing for a visit to their office by the CFPB. Presented by Wendy Bernard, of the Bernard Law Group.

We've put together a panel that's deep into these issues. In Connecticut, and elsewhere, legal authorities continue to look at mortgage lending practices, servicing issues and consumer complaints as they forge new initiatives to control the mortgage lending environment. Attorney General Jepson is our invited guest to speak on his view of what the mortgage community should be doing, and what it should be expecting from government leaders.

WENDY BERNARD
Wendy BernardAttorney Wendy Bernard has more than 20 years diverse experience in the mortgage banking industry, inclusive of 10 years experience as regulatory compliance counsel to lenders, brokers and mortgage loan originators. Advise clients on matters pertaining to Federal and State banking law and regulation, licensing and qualification under the S.A.F.E. Act, and develop strategies for a vast array of mortgage banking/brokering transactions to ensure compliance under TILA, REG Z/MLO Comp Rule, RESPA, ECOA, HMDA, HOEPA, HERA, FCRA/FACTA, GLBA, Red Flags, AML/SAR, among others.

Attorney Bernard is also an active industry participant, serving on the Board of the National Association of Mortgage Professional’s (NAMB) Connecticut Chapter -- the Connecticut Mortgage Association -- and advocating for industry through Lobby Day meetings with Legislative Representatives at the nation’s Capitol. She is also an instructor of Continuing Education for mortgage professionals and represents clients who face administrative action and license deficiencies.

In addition, she is also an Adjunct Professor of Law at Post University, Connecticut and a veteran and Judge Advocate General (JAG) in the United States Army Reserve, with seventeen years of honorable military service thus far, proudly serving.
 

MARK BURTON
Mark Burton is Senior Vice President – Production Manager with Northeast Home Loan, headquartered in southern New Hampshire, where he oversees third party relationships and other strategic initiatives.He has been in the mortgage industry for 30 years.


His prior experience includes being Senior Vice President with Bankers Advisory, a Boston-based provider of quality control and compliance auditing services.  Before joining Bankers Advisory, Mark was as an institutional relationship manager in the reverse mortgage industry where he was Director of Community Lending Services for American Home Bank Reverse, a division of First National Bank of Chester County.  Before that he was a founding officer of EverBank Reverse, formerly the reverse mortgage division of MetLife Home Loans. He spent 16 years at Fannie Mae, much of which in institutional account management, as well as credit risk management, product development, and bulk acquisitions.

Mark is a graduate of Williams College and holds graduate degrees from the University of Massachusetts and Temple University.  

Maureen DevineMAUREEN DEVINE
Maureen Devine is Owner/Executive Vice President of Strategic Information Resources, based in Springfield, Mass. She serves as a director of the National Consumer Reporting Association, and is chair of its education and compliance committee. She is also a former treasurer of the Vermont Mortgage Bankers Association.


ELTON "BUD" HARVEY
Elton (Bud) Harvey has been an attorney since 1986. His practice emphasizes commercial and residential transactional matters and real estate litigation. Prior to entering into private practice in 1988, he owned his own title abstract company and was employed in the title insurance industry. He is the Vice Chair of the Executive Committee of the Connecticut Bar Association Real Property Section. Mr. Harvey has received a rating of AV from Martindale and Hubbell.

A frequent lecturer in real property matters, he works with agents and clients in short sales and foreclosure matters. He teaches real estate law, basic title searching, foreclosure and short sale classes as an adjunct faculty member of Manchester Community College and Naugatuck Valley Community College. He is a member of the Connecticut Mortgage Bankers Association and is on the Closing and Compliance Committee and the Affordable Housing Committee.

Mr. Harvey received a B.A. from The University of Connecticut in 1969, a M.A. from The University of New Haven and a J.D. from Western New England College School of Law in 1986. He was admitted to the Connecticut Bar on May 8, 1986.


THE HON. GEORGE JEPSON (invited)
George Jepsen is the 24th Attorney General to serve Connecticut since the office was established in 1897. He took office on Jan. 5, 2011. The Attorney General is a constitutional officer, the state’s chief legal officer and serves as legal counsel to all state agencies. Under state statutes and the Connecticut Constitution, the Attorney General has authority over all civil matters and is responsible for representing the people of Connecticut and the broader public interest.

With a legal staff of more than 200 attorneys, the Attorney General works to represent and vigorously advocate for the interests of the state and its citizens, to ensure that state government acts within the letter and spirit of the law, to protect public resources for present and future generations, to preserve and enhance the quality of life of all our citizens, and to ensure that the rights of the most vulnerable citizens are safeguarded. The Office generated $477 million for the fiscal year ended June 30, 2011.

Attorney General Jepsen is a member of the National Association of Attorneys General, where he serves as co-chairman of the Antitrust Committee. He was also a member of the executive committee and negotiating team that resulted in a $25 billion settlement with the nation’s five largest banks over mortgage foreclosure abuses. It was the largest joint federal-state settlement in history. As Attorney General, Jepsen created a data privacy task force to focus on data breach and privacy concerns. He has also focused on utility issues.

Before taking office, Jepsen was a practicing lawyer for more than 26 years, most recently at the Hartford law firm of Cowdery, Ecker and Murphy, LCC, in the areas of corporate transactions and civil and appellate litigation. Jepsen began his legal career as general counsel to Carpenters Local 210 in Norwalk.

In 1987, Jepsen was elected to represent Stamford’s 148th State House District. From his election in 1990 through 2003, Jepsen represented the 27th State Senatorial District, serving Stamford and Darien. As a state senator, Jepsen was chairman of the Judiciary Committee (1993-1995) and ranking member of the Finance Committee (1995-1997). He served as Senate Majority Leader from 1997-2003. In 2002, Jepsen was the Democratic nominee for Lieutenant Governor. He served as Democratic State Party chairman from 2003-2005.  

DONATO (DENNY) MAISANO
Donato MaisanoDenny Maisano serves as the Director of the Appraisal Management Division of Strategic Information Services, based in Springfield, Mass. He is responsible for all regulating, quality control and panel management within the division. Mr. Maisano also serves as the president of Real Estate Lending Services Inc., based in Cheshire, Conn. He has been in the real estate and lending industries since 1973. Prior to establishing Maisano Associates, Real Estate Appraisers, in 1978, he served as mortgage officer and chief appraiser for New Haven Savings Bank. Mr. Maisano has also served as the director of industry relations for Connecticut Attorneys Title Insurance Co. RELS, founded in 1994, is a real estae and financial services consulting company. This firm provides quality control, loan placement, appraisal analysis and portfolio services on an institutional and individual basis in the Northeast.

An active participant in various trade associations, Mr. Maisano is a past member fo the national Board of Directors of the Appraisal Institute and served on its Government Relations Committee from 1996-2003. On a local level, he has held numerous offices in the Conn. chapter, including President and Treasurer, between 1986 and 1993. Mr. Maisano has been an active member of the Conn. Mortgage Bankers Association since 1988, serving as Secretary and a member of its Executive Committee. In 1996, Gov. John Rowland appointed him chair of the Connecticut Real Estate Appraisal Commission. Since the conclusion of his term as Chair in December, 2003, Mr. Maisano has provided clients with advice on appraiser independence and regulatory issues.

JEREMY POTTER
Jeremy Potter joined Norcom as chief compliance attorney with experience in the government contracting community serving as a market analyst in the metro D.C. area for regulatory and policy issues at the market research firm INPUT Inc. While with INPUT, Potter published several industry reports, hosted presentations, appeared on a bi-weekly radio show on Federal News Radio and authored posts on an industry blog. Potter graduated from the University of Connecticut School of Law where he served as an Associate Editor of the Connecticut Public Interest Law Journal and won an award for mock trial advocacy. Mr. Potter published a note titled Legal Education and Moneyball: The Art of Winning the Game of Assessment in the Spring/Summer 2012 issue of Connecticut Public Interest Law Journal. He came to Norcom after internships in the Connecticut Attorney General's Office, Connecticut General Assembly and with Wiggin and Dana LLP in Hartford, CT. He also has a B.A. in Political Science from the University of Mary Washington in Fredericksburg, VA where he graduated cum laude with honors.
